Can someone take monies from a tax account to pay mortgage payments for a deceased person, then turn around and ask the estate for a refund?

If the account was set up strictly for taxes, and not just a savings account that is unofficially for taxes ... No.  That would be misuse of funds, and illegal.  It wouldn't matter if the money was paid back to the account or not.

Also - the estate should be paying any mortgage directly.
